What You Should Know About Child Custody and Parenting Time in Wisconsin

Wisconsin law assumes that it will be in the best interests of children to have quality time with both parents. Similarly, it is assumed that both parents are qualified to have primary custody of the children.  Therefore, even if one spouse was at fault for “causing” the divorce, Wisconsin courts will not “punish” the responsible spouse by taking away parenting time.

In determining primary custody arrangements, Wisconsin courts do not automatically favor mothers over fathers in awarding custody.  Instead, courts will usually consider factors such as:

  • The wishes of the parents,
  • Which parent has been primarily responsible for taking care of the children, such as making meals, taking the children to school, etc.,
  • What changes might affect the children by living with one spouse or the other, such as whether children might need to attend a different school,
  • If the child is sufficiently mature, the preference of a child to live with one parent over another.
